Terms of Service & EULA

1. Acceptance of Terms

By downloading, installing, or using NFC Monsters ("the App"), you agree to be bound by these Terms of Service ("Terms") and Apple's Standard EULA. If you do not agree to these Terms, do not use the App. These Terms apply to all users of the App.

2. License Grant

Subject to your compliance with these Terms, NFC Monsters grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on Apple-branded or Android devices that you own or control, solely for your personal, non-commercial use. This licence is governed by Apple's Standard EULA where applicable.

3. In-App Purchases & Subscriptions

The App offers optional in-app purchases and a recurring subscription ("Monster Pass"). By making a purchase you confirm you are aged 13 or over (or have parental/guardian consent).

• Subscription (Monster Pass): Billed monthly at the price shown at purchase. Your subscription automatically renews unless you cancel at least 24 hours before the end of the current billing period.
• Managing / Cancelling Subscriptions: On iOS, manage your subscription at any time in your Apple ID Account Settings or at apps.apple.com/account/subscriptions. On Android, manage via Google Play.
• No Cash Value: All in-game currency (Gold, Monster Snacks) and virtual items have no real-world monetary value, are non-transferable, and cannot be exchanged for cash or any other goods or services outside the App.
• Refunds: Purchases are final and non-refundable except as required by applicable law. For iOS, refund requests must be made through Apple. For Android, through Google Play.
• Price Changes: We may change subscription prices. You will be notified in advance and given the opportunity to cancel before any price change takes effect.

4. Virtual Currency & Items

All virtual currency and items (including monsters, Gold, and Monster Snacks) are licensed to you, not sold. We reserve the right to modify, adjust, or remove virtual currency and items at any time. We are not responsible for the loss of any virtual items resulting from account termination or suspension.

5. Account Registration & Security

• You are responsible for maintaining the confidentiality of your account credentials.
• You must not share your account with others or allow others to access it.
• You must notify us immediately of any unauthorised access to your account.
• We are not liable for any loss resulting from unauthorised use of your account.

6. Acceptable Use

You agree not to:

• Use cheats, bots, automation scripts, or any unauthorised third-party software
• Exploit bugs or glitches — report them to us instead
• Harass, threaten, or abuse other players
• Attempt to reverse-engineer, decompile, or modify the App
• Use the App for any unlawful purpose
• Create multiple accounts to gain unfair advantages
• Sell, trade, or transfer your account to another person

7. NFC Tags & Physical Products

NFC Monsters physical tags are sold separately. Each tag is a one-time-use item. Once a tag has been scanned and claimed by any player, it cannot be redeemed again. We are not responsible for lost, stolen, damaged, or counterfeit tags. Physical product returns are subject to the retailer's return policy.

8. Intellectual Property

All content within the App — including but not limited to monster designs, artwork, text, music, and code — is owned by NFC Monsters or its licensors. You may not reproduce, distribute, or create derivative works from any App content without our express written permission.

9. Advertisements

The App may display rewarded video advertisements. You can earn in-game rewards by choosing to watch ads. Purchasing certain premium items permanently removes interstitial ads. Rewarded ads remain available as an optional feature. Ad serving is managed by third-party networks in accordance with their own terms and privacy policies.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses. To the fullest extent permitted by law, we disclaim all warranties.

11. Limitation of Liability

To the maximum extent permitted by applicable law, NFC Monsters shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the App — even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid for the App in the 12 months prior to the claim.

12. Termination

We reserve the right to suspend or permanently terminate your access to the App at our discretion if you breach these Terms. Upon termination, your licence to use the App ceases immediately. Any outstanding in-app purchases are non-refundable upon termination for cause.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via an in-app notice. Continued use of the App after the effective date of any changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of England and Wales.
